1. Your agreement with Shipped

These terms govern your use of the Shipped website, dashboard, APIs, MCP connector, deployment tools, and hosting services (the “Services”). “Shipped,” “we,” and “us” mean Shipped Inc.. “You” means the person or organization using the Services.

By creating an account or using the Services, you agree to these terms and the Acceptable Use Policy. If you act for an organization, you confirm that you have authority to accept these terms for it. You must have the legal capacity to enter this agreement. Our Privacy Policy explains how we handle personal information.

2. Accounts and authorized actions

Keep account and billing information accurate, protect credentials, and give collaborators and integrations only the access they need. You are responsible for activity by people, agents, and tools you authorize. Tell us promptly if you suspect unauthorized access, and revoke compromised credentials or integrations.

An agent can act on your behalf within the permissions you grant. Review its proposed deployments, configuration changes, data operations, and spending approvals. Connecting an agent does not give it permission to exceed the spending limits you authorize.

3. Your code, applications, and data

You retain ownership of the source code, applications, files, databases, and other content you submit (“Customer Content”). You give Shipped permission to receive, copy, build, execute, store, transmit, back up, and display Customer Content as needed to provide and secure the Services and carry out your instructions. This permission is limited to those purposes and the retention described in our Privacy Policy.

You must have the rights and permissions needed to upload and run Customer Content, including third-party code, packages, images, and data. Review AI-generated code and its dependencies before deployment. You are responsible for your application’s behavior, user notices, required consents, legal compliance, and any goods or services it offers.

Use the designated secret-management tools for credentials. Check the files included in a deployment; ignore rules and secret detection cannot guarantee that an upload contains no sensitive information. Maintain backups and export plans appropriate to your application, including any backup options you select on Shipped.

4. Using the platform

Shipped provisions and operates resources for the configurations you select. Available features, resource limits, supported runtimes, and charges are described in the product and your order. You remain responsible for your application code and configuration.

Builds may download dependencies and execute your build instructions. Deployments, migrations, and other changes can affect availability or data. A rollback of application code does not necessarily reverse database migrations, external actions, or changes to stored data.

Third-party services you connect are subject to their own terms and policies. You authorize the access necessary for the integrations you enable and can revoke that access. No availability guarantee or service credit applies unless it is expressly included in a separate agreement with you.

5. Payments and usage credits

Your order and the rate card shown when you purchase describe the subscription price, billing period, included usage credits, resource rates, taxes, and any separately charged resources. Shipped usage credits account for eligible platform usage. They are not a bank deposit or an investment.

Included monthly credits reset each billing period. Purchased credits and promotional credits may have different conditions. Any expiry, rollover, refund, or transfer conditions must be disclosed with the relevant purchase or grant. Usage is deducted according to the applicable rate card. You can review recorded usage and credit activity in your account.

Optional top-ups or recurring purchases require your authorization and are subject to the limits you select. Reaching a usage or spending limit may restrict deployments or service availability. Deleting code or stopping a web service does not automatically cancel other billable resources you keep, such as stored data or dedicated resources.

Subscription renewal, cancellation timing, and the treatment of unused credits are governed by the terms displayed at purchase and any mandatory consumer rights. Cancelling does not remove charges already incurred. If you believe a charge is wrong, contact us with the relevant invoice or usage details. Nothing in these terms limits a refund or other remedy required by law.

6. Suspension, cancellation, and export

We may restrict or suspend the affected Services to respond to a security incident, unlawful activity, a breach of these terms, non-payment, or a risk to the platform or others. When practical and legally permitted, we will explain the reason and give you a reasonable opportunity to resolve it. Urgent threats may require immediate action.

You may stop using the Services and cancel through your account. Before deleting an account or resource, export the data you need and review any applicable retention and recovery information. Account closure may make applications unavailable and begin deletion of Customer Content. We may retain limited records where needed for legal, billing, fraud-prevention, or dispute-resolution purposes.

A spending limit or failed payment does not by itself authorize immediate deletion of your stored data. The applicable service terms will describe a finite recovery period, any authorized charges for retained data, notices, export options, and the point at which deletion may occur. Retention is not indefinite.

Rights and obligations that by their nature continue after termination, including accrued payment obligations, ownership, and applicable liability provisions, remain in effect.

7. Warranties and responsibility

We will provide the Services with reasonable care. Except for express commitments in your agreement and warranties that cannot legally be excluded, the Services are provided on an “as available” basis. We do not guarantee that every application or third-party dependency will operate without interruption or error.

To the extent permitted by applicable law, neither party is responsible to the other for indirect or consequential losses arising from this agreement. This does not exclude responsibility that the law does not allow a party to exclude, including applicable statutory consumer rights. Any further limitation of liability must be expressly agreed in the applicable order or service agreement.

8. Changes, disputes, and contact

We may update these terms as the Services change. We will publish the revised terms with an effective date and provide notice of material changes through an appropriate account or service channel. Changes will apply prospectively, subject to any notice or consent required by law.

The governing law and dispute-resolution provisions must be finalized before these terms take effect.

Questions about these terms: contact details will be added before publication.
